About AVY

Most of what the Uttar Pradesh building and other construction workers' welfare board sanctions is money: a lump sum, a monthly instalment, a reimbursement against a fee receipt. This scheme sanctions a place instead. A registered construction worker's child gets a seat in a residential school, with the bed, the clothes and the meals attached, and the national scheme record files the benefit as in kind with no direct benefit transfer against it. A parent watching a bank passbook for this one is watching the wrong thing.

The scheme was written around where these children actually live. The board's notification opens on the observation that construction workers' children stay with their parents at the work site, and that the parents' poverty and lack of means leave many of those children never admitted to a school at all, or unable to carry on after they are; what it proposed in answer was a school the board pays for, rather than a fee subsidy paid to a school the family still has to find (Awasiya Vidyalaya Yojana notification, UP Building and Other Construction Workers Welfare Board).

What the board undertakes to provide is primary, junior high school and secondary education for children aged 6 to 14 whose parents are registered with it (UPBOCW scheme list).

The notification started the scheme in twelve named districts, Etawah, Bhadohi, Kannauj, Moradabad, Firozabad, Lalitpur, Bahraich, Ghaziabad, Kanpur, Azamgarh, Agra and Meerut, and left any extension to other districts to the board chairman's approval, on the strength of experience and need (scheme notification).

One line further down the board's own scheme list matters more than any of that for a parent planning ahead: these residential schools are to be merged into the Atal Awasiya Vidyalayas once those begin operating (UPBOCW scheme list). It is a standing arrangement with an announced end state, not a permanent parallel system.

Important dates

No application window is published for this scheme. The national scheme record carries neither an opening nor a closing date, and the board's own list announces no annual cycle for it, which fits a scheme filled at district level rather than through a state examination.

The one timing rule the board does publish sits at the foot of that list and covers everything it runs: the time limit for applying is fixed at one year. The list does not say what the year is counted from, so the practical answer is unchanged. Ask at the district labour office where the parent is registered, and watch the board's notices and press pages, which is where a district level admission notice would surface if one is issued (UPBOCW scheme list).

Who can apply

Eligibility criteria

Two conditions decide it, and only one of them is about the child. The child has to fall inside the 6 to 14 age band. The parent has to be a registered beneficiary of the board, which under the governing statute means a building worker who has completed eighteen years of age but not sixty, and who has been engaged in building or other construction work for not less than ninety days during the preceding twelve months (Building and Other Construction Workers Act, 1996, section 12, Office of the Chief Labour Commissioner).

The interesting part is the condition that is missing. The board's other education benefit, the Sant Ravidas Shiksha Protsahan Yojana, asks for at least 365 days of board membership after registration (UPBOCW scheme list); the Atal residential schools, in the rules the Ghaziabad district administration publishes for them, ask for five years (Atal Awasiya Vidyalaya Yojana, Ghaziabad district administration). This one asks for none. A worker who registered this season, with a child inside the age band, is already in the eligible set.

Who cannot apply

Exclusions

The board publishes no exclusion list for this scheme, so nothing here is written as a formal bar. The rule that actually ends a claim sits in the statute rather than in the scheme: a beneficiary who has not paid the contribution for a continuous period of not less than one year ceases to be a beneficiary, which takes the parent, and with the parent the child, out of scope until it is put right (Building and Other Construction Workers Act, 1996, section 17).

Renewal conditions

Nothing about the child's place has to be renewed by the family once a child is admitted. Two other things do, and both sit outside the application form.

The first is the parent's own registration, which stays alive only while the contribution keeps being deposited. The Act leaves two ways back. Where a worker cannot pay because of financial hardship the Board may waive the contribution for a period not exceeding three months at a time; where it has already stopped, the Board's Secretary may accept the arrears and restore the registration if the reason for missing them was a reasonable one (Building and Other Construction Workers Act, 1996, sections 16 and 17).

The second is the school's own contract. The notification has the board pick an institution to run the school and sign an agreement with it through the Secretary, fixing the operating conditions and the payment process, and it makes renewal of that agreement turn on an evaluation carried out by a board-nominated body on the strength of the supervision reports (scheme notification). A school can change hands between sessions without the child's eligibility changing at all.

There is no sanction amount here, because nothing is paid to the family. What the board undertakes is specified item by item in the notification, and the detail is worth reading before a parent pictures a village school with a dormitory attached.

The schools are fully residential, run single sex or co-educational as a district needs. Boys and girls get separate hostels, each with its own kitchen, its own dining hall, its own toilets and bathrooms, and a room set aside for the warden. Children are fed morning breakfast, a midday meal, evening tea and dinner, on a menu the board fixes rather than the institution running the school. Clean drinking water, sport and recreation are written into the hostel as requirements rather than extras, and every school has to carry an electricity connection. Teaching follows the syllabus of the Basic Shiksha Parishad, CBSE or ICSE, whichever the board prescribes for that school.

The staffing is prescribed too, which is what separates this from a hostel with a teacher attached: four full time teachers and three part time teachers to a school, with a warden, an accountant, watchmen, a head cook and an assistant cook alongside them (scheme notification).

The notification also stages the schooling rather than simply admitting a child to a class:

That bridge course is the whole design showing through. A child who reaches the school at nine having never been enrolled anywhere is not put back with six year olds; the scheme expects to compress the primary years and move them on.

Documents required

The board asks for two papers, and the second is the one that goes stale. A photocopy of the registration certificate proves the parent is on the register. Evidence that the contribution is deposited up to date proves the registration is still live, which is a different claim, and the one a lapsed worker cannot make (UPBOCW scheme list).

Both can be assembled before the form is filled rather than chased after it is refused. A current copy of the registration prints from the worker menu on the board's site, under Labour Certificate (Labour Certificate, UPBOCW).

Step by step

How to apply

The route is offline and it runs through the labour department, in two steps that have to happen in that order: the parent registers as a construction worker first, then submits the scheme application with the documents to the labour department. A child cannot be applied for by anyone other than a registered worker, which is why families whose registration has lapsed are effectively applying twice.

Registration and renewal have themselves moved onto the board's site, so the paperwork the offline application depends on is generated online (Worker registration, UPBOCW).

Tracking is the part most parents ask about, and it is worth being clear about what there is to track. Because the benefit is in kind, no credit will ever appear in a passbook, so a bank statement tells you nothing. What the board exposes instead sits in two menus on its site. Under Schemes, Scheme Application Status shows where a submitted scheme application has reached (Scheme Application Status, UPBOCW), and List Of Labours Benefited From Schemes shows the workers already sanctioned a benefit (Beneficiary list, UPBOCW). Under the worker menu, Registration Status and Renewal Status answer the prior question of whether the parent's registration is still standing, which is the usual reason a scheme application stops moving (Registration Status, UPBOCW).

How winners are picked

Selection process

The notification sets no entrance test, no interview and no merit list. Eligibility is the whole filter, and the only actor it puts between an eligible child and a seat is the institution the board picks to run the school, Mahila Samakhya or a non-governmental or voluntary organisation, which appoints the teaching and non-teaching staff and handles the school's recognition. Who decides an individual admission is written down nowhere in the scheme, which is why the district labour office, rather than this document, is what a family has to work through (scheme notification).

That silence is worth noticing precisely because the better known scheme next to it works the other way. The Atal residential schools hold an entrance examination every year and take the candidates who pass it on merit (Atal Awasiya Vidyalaya Yojana, Ghaziabad district administration). Parents who go hunting for an exam date for this scheme are looking for something the notification never created.

Fine print

Terms & conditions

Supervision is continuous rather than annual. The local labour office and the board inspect the schools and send the supervision report to the regional Deputy Labour Commissioner and to the board, the District Magistrate of the district may inspect either personally or through subordinate officers, and a board-nominated body evaluates the school on those reports (scheme notification).

Two further conditions are set out in the notification itself. The budget for running a school is benchmarked to the Kasturba Gandhi Balika Vidyalaya, so the cost per child is not negotiated school by school. And the Secretary of the board is empowered to issue directions to remove any difficulty arising in the running of the scheme, which is the clause under which operational changes get made without a fresh notification.
