Rule 282 hands the timing to the Board rather than to a season written into the rules: an application in Form XLV goes in within such time as the Board may specify (Rule 282, Bihar BOCW Rules 2005). Form XLV then pins the claim to one year, asking for the session of admission and for the year of tuition fee being claimed, so the admission is the clock a family should actually watch.

One dated window still matters. Registration, renewal and scheme applications on the old portal were stopped with effect from 27.02.2026 so the migration could be completed, and the new portal opened on 08.05.2026 (Secretary, Bihar BOCW Welfare Board, letter of 07/05/2026); files left pending were carried across rather than closed. The same letter records that the period allowed for applying under an earlier board order may have run out for some workers while the portal was shut, and that those workers will be given additional time to apply, with a further order to follow. A family that watched a deadline pass in those months has something specific to ask the district office for.

The clock that matters starts at registration, not at admission. The board's brochure opens this benefit to the sons and daughters of workers who have finished a minimum of one year of membership, and the membership has to still be running when the claim goes in (Bihar BOCW Welfare Board scheme brochure).

Getting on the register at all has its own test. A building worker between the ages of 18 and 60 who has put in 90 days of building work in the preceding year, and who is not a member of any other welfare fund set up under any law in force, is eligible for the fund on an application carrying a registration fee of Rs 20 (Rule 266, Bihar BOCW Rules 2005).

Keeping the membership live is cheap and easy to forget. The brochure prices the contribution at 50 paise a month, collected as a single Rs 30 payment at registration to cover 5 years, so registration and contribution together come to Rs 50 at the counter, after which the worker has to renew (Bihar BOCW Welfare Board scheme brochure). Families who registered once during a site drive and never went back are the ones who discover, at admission time, that the card in the drawer is not a card the board recognises.

On the student's side the whole test is the seat. The course has to be one the board has specified and the institution has to be a government one, which is why Form XLV asks for the college's name and the university or board it is affiliated to before it asks what the year's tuition comes to.

The first bar operates before this scheme is ever reached. A worker engaged in construction work under the Factories Act, 1948 or the Mines Act, 1952 is not covered by this board at all (Bihar BOCW Welfare Board scheme brochure), so a family whose earner sits inside a factory or a mine cannot route a college claim through a construction card.

The seat is the next disqualifier. A private college, however good, falls outside the course list, because every band the board publishes is written against a government institution (Bihar BOCW Welfare Board scheme brochure). The quietest one is the parent's own arrears: a beneficiary who defaults on the contribution continuously for a year ceases to be a beneficiary of the fund (Rule 267, Bihar BOCW Rules 2005), which ends the child's claim along with the membership.

Form XLV puts three questions about the parent before it asks anything at all about the college: the period of membership, whether the membership is currently running, and the date of the last renewal. That is what this scheme renews. The grant itself is settled once against a course, and a claim for a second child or for the same child's next course is judged against whatever standing the parent holds on that later date.

A lapsed membership can be brought back. The brochure lets the registering officer revive a membership that broke for non-payment once the worker deposits the arrears at 50 paise a month, and will not revive it more than twice (Bihar BOCW Welfare Board scheme brochure); the rule behind it adds a fine of Rs 2 per month and sets the same ceiling (Rule 267, Bihar BOCW Rules 2005).

What the board pays turns on which door the child got through. A seat at a premier government institute of the IIT, IIM or AIIMS kind carries the tuition fee itself. A B.Tech or equivalent degree in a government institution carries the largest of the fixed lump sums, a government polytechnic or nursing diploma carries a smaller one, and a government ITI trade carries the smallest, each paid once on admission. The transfer goes to the worker's own bank account rather than to the college. Board welfare money moves by RTGS into the beneficiary's account (Bihar BOCW Welfare Board scheme brochure), and the sanctioned amount is now routed through the board's portal into the worker's Aadhaar seeded account (Secretary, Bihar BOCW Welfare Board, letter of 07/05/2026). Fee receipts still matter, because the claim is built on proof that the fee was paid, but the reimbursement lands with the parent.

The claim runs on Form XLV in its amended version, the form the 2005 Rules name for this benefit (Rule 282, Bihar BOCW Rules 2005). Beyond the identity and residence papers any welfare claim needs, the form asks for a specific set of facts, several of which sit in the parent's registration record rather than in the child's admission file:

• The registration number and the date of registration, the age and date of birth recorded at registration, the category of building work the parent does, and the caste category.
• The period of membership, whether the membership is currently running, and the date of the last renewal.
• The child's name and date of birth, the name of the course the child has been admitted to with the admission proof attached, and the session of admission.
• The name and address of the college, and the university or board it is affiliated to.
• The year of tuition fee the claim is being made for.
• The Aadhaar number with a photocopy, and the bank name and branch, the account number that has been seeded with Aadhaar, and the IFSC code, with the passbook photocopy attached.

The photograph box on the form is not the worker's alone: it asks for a passport size photograph of the son or daughter together with the applicant. The declaration at the foot is a certification that the bank account given has been linked to the Aadhaar number, which is the same condition the payment side enforces later.

The claim is filed online by the registered worker on the board's portal, and the address changed recently enough that stale links are a real problem. The board's Secretary informed all Deputy Labour Commissioners, Assistant Labour Commissioners, Labour Superintendents and Labour Enforcement Officers that the new portal www.bocwboard.bihar.gov.in was being made operational from 08.05.2026, the old portal having been closed for migration with effect from 27.02.2026 (Secretary, Bihar BOCW Welfare Board, letter of 07/05/2026).

Biometric authentication is not optional here. The same letter records that Aadhaar based biometric authentication is built into registration and renewal, that family members are verified biometrically as well, and that biometric authentication is compulsory at the moment the worker applies for a scheme benefit. A claim for a child is a claim that touches both, so the worker and the child's record have to be in a state where that authentication actually succeeds.

The same portal is where the file lives afterwards. The Secretary's letter lists the application itself, its disposal by the concerned officers, appeal, grievance redressal and profile update among the functions built into the new portal, and records that every application left pending on the old one now displays on the new one for disposal, so a file submitted before the migration has not vanished and does not need refiling (Secretary, Bihar BOCW Welfare Board, letter of 07/05/2026). The application status page the scheme record still points to sits on the retired bocw address, which no longer resolves at all.

Payment is a separate question from sanction. The sanctioned amount is transferred through the portal into the worker's Aadhaar seeded account (Secretary, Bihar BOCW Welfare Board, letter of 07/05/2026), so an approved claim that has not arrived turns on whether the account named in Form XLV is genuinely seeded, which is the exact thing the declaration at the foot of that form certifies. The board also instructed every Labour Enforcement Officer to keep a file per beneficiary holding hard copies of all documents attached to the online application and of the inquiry report, so the district office can say precisely what its copy of the file contains.

A May 2026 office order set the chain down in one place, and it is a chain of three named officers rather than a merit list: the Labour Enforcement Officer inquires, the Labour Superintendent sanctions or rejects, and an Assistant Labour Commissioner hears an appeal against a rejection.

Two instructions shape what the inquiry officer actually does. The checklist circulated by the board has to be filled in with the required information and uploaded to the portal, and the board has warned that where it is not, responsibility will be fixed on the inquiry officer and on the Labour Superintendent named to sanction the scheme. The board has also put on record that the portal is in no circumstance a substitute for physical verification, site inspection or verification of records (Secretary, Bihar BOCW Welfare Board, letter of 07/05/2026). An officer visiting the site or asking to see the originals is following the instruction, not obstructing the claim.

The appeal is the new part. Until that order, a worker whose application was rejected had no appeal route at all, which is why rejected applicants had been sending representations to whichever office would take them; the order names the Assistant Labour Commissioner posted in each division as the appellate authority, gives the worker 30 days from the rejection to file on the portal, and requires the appeal to be disposed of through the portal after a review of the records (Bihar BOCW Welfare Board office order on scheme appeals).

What decides a file is the parent's paperwork on the day it is filed: a membership a year old and still running, a contribution that is current, and the bank account named in Form XLV already seeded with Aadhaar, because that is the account the sanctioned amount is pushed into (Secretary, Bihar BOCW Welfare Board, letter of 07/05/2026).

Sixteen welfare schemes run under this board (Bihar BOCW Welfare Board office order on scheme appeals), and the brochure makes a separate application in the prescribed form compulsory for every one of them except the annual medical assistance (Bihar BOCW Welfare Board scheme brochure). The institution condition is absolute in the published bands: government institutions only, across the degree, diploma and trade routes alike. And because the board's rules make the amount and the course list a matter for the Board to determine from time to time, a family should read the current band on the portal before budgeting against a figure quoted second-hand.
